General refurbishment 2016

Around € 750,000.00 was invested in the new Montafon Kristbergbahn between March 29, 2016 and May 25, 2016. The entire control technology, electrical engineering and braking technology, as well as the gondola and the exit were completely renewed. The complete refurbishment resulted in a major increase in comfort. All information about the general refurbishment can be found here.

Conditions of Carriage (Terms and Conditions)

1. Conclusion of contract

a) These General Terms and Conditions (GTC) apply between the contractual partner and the purchaser (hereinafter “customer”) of a ticket with the designation “WildPass” (season ticket, annual pass, multi-day pass, sunshine pass, etc.), “Ländle Card”, or “Kristberg Montafon”, or of a ticket that entitles the holder exclusively to the use of the facilities of Montafoner Kristbergbahn Silbertal GmbH (e.g. day tickets, single rides) (hereinafter “ticket”). A ticket entitles the customer to use the cable car and lift facilities, pistes, routes and trails (hereinafter “facilities”) of the contractual partner to the extent defined in the tariff provisions for the respective ticket (see websites of the contractual partners). In the event of dispute, the contractual partner is obliged to prove the accessibility and effective inclusion of these GTC and tariff provisions in the contractual relationship.

b) Framework contract – representation of other cable car companies

The cable car companies and their partner businesses – regardless of their legal form – that are part of the “WildPass” ticket network (Silvretta Montafon, Golm Silvretta Lünersee Tourismus, Gargellner Bergbahnen, Montafoner Kristbergbahn Silbertal GmbH, Brandnertal, etc.), as well as other ticket networks such as the “Ländle Card” or “Kristberg Montafon” (Montafoner Kristbergbahn Silbertal GmbH), operate their respective facilities independently and on their own legal responsibility. When purchasing such a ticket, a framework contract is concluded, and the respective cable car company acts as a representative on behalf of these other companies, or in the case of tickets designated as “WildPass”, on behalf of Bergbahnpool Montafon Brandnertal OG.

c) The specific carriage contract (individual contract) is concluded by the use of the ticket at the respective access systems, but only with the cable car company (e.g. Montafoner Kristbergbahn Silbertal GmbH) whose facilities the customer is currently using. Any liability arising from the carriage contract (individual contract) towards customers, or based on other contractual or statutory provisions, for incidents occurring during the operation and use of the cable car and lift facilities, ski pistes and routes, lies exclusively with the company in whose area the incident took place. There is no liability on the part of the other cable car companies of other ticket networks (“WildPass” or “Ländle Card”) or Bergbahnpool Montafon Brandnertal OG. In particular, there is no liability arising from the framework contract. Bergbahnpool Montafon Brandnertal OG does not provide carriage services.

d) When purchasing tickets that entitle the holder exclusively to the use of the facilities of a single cable car company (e.g. Montafoner Kristbergbahn Silbertal GmbH) (e.g. day tickets, single rides), the carriage contract is concluded solely with this cable car company (e.g. Montafoner Kristbergbahn Silbertal GmbH).

e) If tickets are purchased from third parties (such third parties include external sales outlets such as Montafon Tourismus and other points of sale, particularly “Stand Montafon”, sports shops, hotels, tourism offices, etc.), these third parties act, depending on the type of ticket, either as representatives for the conclusion of the framework contract or as representatives of the respective cable car company (e.g. Montafoner Kristbergbahn Silbertal GmbH) for the conclusion of the individual carriage contract.

f) The carriage contract only applies to the use of the areas that are open (cable car facilities, pistes, ski routes, etc.) during the announced operating hours. Contractual claims against the cable car company therefore only exist for the duration of the announced operating hours (for the ski area visited by the customer) and only for the areas that are open.

2. Content of the contract

a) The prerequisite for using the services of the cable car companies is the purchase of a valid ticket. This entitles the holder to use the areas that are open (cable car facilities, pistes, ski routes, etc.).

b) By purchasing a winter ticket, the customer acquires the possibility to use at least 60% of the cable car facilities on at least 70 days during the winter season.

c) By purchasing a summer ticket, the customer acquires the possibility to use at least 60% of the summer lifts on at least 70 days during the summer season.

d) By purchasing an annual ticket, the customer acquires the possibility to use at least 60% of the cable car facilities during the winter season on at least 70 days, and at least 60% of the summer lifts during the summer season on at least 70 days.

e) The purchase of the ticket is subject to the prices announced at the time of purchase.

f) The operating times of the facilities operated by the cable car companies can be found on the notices posted at the ticket office. The customer must plan their trips so that they return to the valley or their starting point in good time before closing.

g) It is expressly pointed out that after the end of operating hours, maintenance work takes place (e.g. use of piste machines, winches, etc.), that obstacles (e.g. cables, ropes, hoses, etc.) may be present on the pistes and ski routes, and that this may pose significant dangers.

h) As is generally known, and as has been customary since the beginning of commercial winter sports throughout the Alpine region, it is not always possible for all facilities/pistes of all cable car companies to remain continuously open at all times. For example, this may be necessary to protect customers from alpine dangers. It is widely known that such restrictions may occur every year; nevertheless, a comprehensive range of services is always available.

3. Obligations of the customer and misuse

a) The customer acknowledges their duty to comply with the FIS rules and to behave considerately towards other customers and the staff of the cable car companies, in particular not to endanger the physical safety of others.

b) The customer must also follow the instructions of the staff of the cable car companies, as these serve the safety of customers and the orderly operation of the cable cars.

c) Upon request by the staff of the cable car companies, the ticket and any evidence of entitlement to a discount must be presented so that it can be verified whether services are being legitimately used. If the customer refuses this obligation, the ticket may be blocked, and transport may be denied.

d) The customer is informed that piste patrols, in accordance with the provisions of the Vorarlberg Sports Act, are authorised to prohibit a winter sports participant from further use of the cable car facilities for 24 hours if the participant commits violations as defined by law or continues such violations despite warnings. Piste patrols are also authorised to confiscate the ski pass or sports equipment. In such cases, the customer is not entitled to a (partial) refund of the ski pass costs.

e) Barriers, markings and instructions from the staff of the cable car companies serve the safety and orderly operation (e.g. avalanche risk, protection of forest areas, etc.) and the safety of other customers and must therefore always be observed.

f) Any improper or abusive use of a ticket (e.g. using services without a valid ticket, disregarding necessary safety instructions, reckless or dangerous behaviour despite warning, use of a discounted ticket without meeting the requirements, transfer of the ticket to third parties for their use, etc.) will result in the ticket being withdrawn. Any remaining days of validity of the ticket will not be (partially) refunded, replaced or credited.

Furthermore, the customer who improperly or abusively uses a ticket (as described above) must purchase a day ticket from the cable car company in whose area they are found in order to settle the services used.

In the case of misuse, the lodging of a report remains reserved, provided the legal requirements are met.

4. Ticket system

a) Tickets are issued on a contactless data carrier (no deposit card).

b) At the time of purchase, first and last name, date of birth, and a photograph taken by digital camera are recorded.

c) This data carrier may not be transferred to third parties for their use.

5. Refunds

a) In the event of serious injury or illness of the customer (which in each case makes further participation in winter sports impossible), a partial refund of the ticket costs may be granted as a gesture of goodwill by the selling cable car company.

b) For this purpose, the injured/ill customer must present a medical certificate (confirming that winter sports can no longer be pursued for the remaining period of validity) and must deposit the ticket with the selling cable car company.

c) A partial refund will then be made from the last day of use, from which point the ticket could no longer be used due to injury or illness. A processing fee of € 7.50 will be retained. If the medical certificate is presented at a staffed ticket office, the refund will be made in cash; if submitted later by email or post, the refund will always be issued in the form of a voucher.

d) For accompanying persons, family members, etc. of an injured/ill customer, a (partial) refund is not possible under any circumstances.

e) If a customer has had their ticket or sports equipment confiscated by a piste patrol (see point 3.d), there is no entitlement to a (partial) refund of the ticket costs.

f) For day tickets and two-day tickets, no refund will be granted in the event of serious injury or illness.

6. Health-related protective measures

a) Compliance with any health-related protective measures officially required of customers in a ski area (e.g. to contain a pandemic) is the sole responsibility of the customer.

b) If a customer cannot or does not wish to comply with officially required health-related protective measures (e.g. proof of vaccination or test, wearing a mask, distancing rules, etc.), transport cannot be provided.

c) In such cases, the customer is not entitled to a (partial) refund of the ticket costs.

7. Data processing

a) The contractual partners are controllers within the meaning of the GDPR for the processing of the customer’s personal data.

b) The customer’s data is processed only in compliance with international and national data protection regulations.

c) The customer receives the complete data protection information under Privacy Information.

8. Miscellaneous provisions

a) For the purchase of passes and the provision of contractual services by the cable car companies, it may be necessary to create and store digital photos. The customer hereby consents to this.

b) For all special tariffs and discounts, an appropriate (original) ID must be presented.

c) The usability of certain facilities (e.g. halfpipes, pistes, lifts, etc.) may be partially restricted.

d) The use of piste rescue services is subject to a fee.

e) All tickets, except points cards, are non-transferable to third parties.
